1. Acceptance of Terms

By accessing or using Atlantian ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Description of Service

Atlantian is a software-as-a-service platform that enables users to create professional proposals, website blueprints, sitemaps, and related documents for their clients. The Service includes web-based tools for document creation, collaboration features, and client presentation capabilities.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:

  • Safeguarding your password and any activities under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring all account information remains accurate and up-to-date
  • All content posted and activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. Subscription and Payment

Some features of the Service require a paid subscription. By subscribing to a paid plan, you agree to the following:

  • Billing: Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan.
  • Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
  • Refunds: Subscription fees are non-refundable except as required by law or as expressly stated in these Terms.
  • Price Changes: We may modify subscription prices with 30 days' notice. Changes will apply at your next renewal.

5. User Content

You retain ownership of all content you create using the Service ("User Content"). By using the Service, you grant us a limited license to host, store, and display your User Content solely for the purpose of providing the Service to you.

You are solely responsible for your User Content and represent that you have all necessary rights to use and share such content. You agree not to upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Atlantian and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service or servers
  • Collect or harvest user data without consent
  • Use the Service for any fraudulent or deceptive purpose
  • Resell or redistribute the Service without authorization

8. Third-Party Services

We do not control and are not responsible for the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of such third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLANTIAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Atlantian, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. All provisions of these Terms that should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Australia.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.
